AQUA MARINE SUP RENTAL TERMS & CONDITIONS AGREEMENT
Stand Up Paddle Boards, Rental Assumption of Risk, Waiver & Release Agreement In the contract below ‘I’ refers (the hirer): ‘SEAFARI ADVENTURES’ refers (the company)
Assumption of Risk: I understand and accept that renting equipment from SEAFARI ADVENTURES and participating in the water activities exposes me to many hazards and entails potential unavoidable risk such as death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in any activity or use when renting equipment. I choose to participate in any Activity with SEAFARI ADVENTURES in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting any equipment and participating in activities with SEAFARI ADVENTURES. I understand the inherent risk involved in using this equipment and accept full responsibility for any and all such damage or injury which may result.
Waiver & Release: In consideration of SEAFARI ADVENTURES renting me this Stand up Paddle Board, I specifically release and forever discharge SEAFARI ADVENTURES and its officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this equipment and participating in organized activities. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of SEAFARI ADVENTURES or its officer agents, or employees. It is my intent by the Waiver and Release Agreement to release SEAFARI ADVENTURES and hold harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by negligence of SEAFARI ADVENTURES or whether based upon breach of contract, breach of warranty, or any other legal theory.
By purchasing a rental period from SEAFARI ADVENTURES I am fully agreeing to this contract, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting this equipment or participating in activities, I will have no right to make a claim or file a lawsuit against SEAFARI ADVENTURES, its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage.
By purchasing a rental from SEAFARI ADVENTURES, I am claiming full responsibility for the equipment and the safety of any other persons who may use the equipment during the rental period, this includes and is not limited to, family members both adults & children, Friends & any other persons which use the equipment during your rental period. I am solely responsible for the equipment I have rented and any accidents I may cause whilst using it or any other person using it. In the event of an accident involving another person or property, I am directly responsible for resolving any costs of damage or injury to any person or property involved.
I REALIZE THE IMPORTANCE OF WEARING A LEASH WHEN PADDLEBOARDING AND I HEREBY COMMIT TO WEARING A LEASH AT ALL TIMES WHILE USING AN AQUA SUPS STAND-UP PADDLE BOARD. WHEN RENTING A MOUNTAIN BIKE I REALIZE THE IMPORTANCE OF WEARING A HELMET SUPPLIED WHEN RENTING FROM AQUA SUPS AND AGREE TO WEAR IT AT ALL TIMES WHEN CYCLING.
I understand that this activity may result in severe injury, including but not limited to spinal or head injury. I understand that this activity may result in hazards posed by other water users and sea conditions. I understand how to operate the rental of a Standup Paddle Board. SEAFARI ADVENTURES & staff has answered any questions that I have.
I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM PHYSICALLY IMPAIRED OR UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
In the event of a cancellation, SEAFARI ADVENTURES refunds:
– 100% with over 3 weeks’ notice.
– No refund within 2 weeks.
Please note: in the event of a cancellation that is requested by a customer, and not the fault of the business, refunds will be minus any transaction fees incurred.
Failure to return the equipment at the time agreed when booking may incur a penalty.
SEAFARI ADVENTURES reserve the right to waive this fee.
SEAFARI ADVENTURES is required to hold a security/damage deposit of €100.00 in CASH which is collected & held when delivery is made and when the equipment is returned in the same working order it was received then the security/damage deposit will be released.
I accept that I am responsible for the replacement value of the equipment if lost or the cost of repair if damaged. Costs of a paddle Board if punctured is €479, Bag €50, Paddle €50, Pump €50, pump tube €20.
If the damage of the equipment is greater than the security/damage deposit held, I agree to pay SEAFARI ADVENTURES the remaining value of damage outstanding to cover the costs of damage/replacement I have caused.
I understand that I have sole responsibility during my hire period and that personal sports insurance cover is my responsibility, and not offered to me by SEAFARI ADVENTURES as part of my hire.
Changes to our privacy policy
We reserve the right to update or alter this privacy policy from time to time without notice to you. This policy was last updated December 2023.
